The Side of Hormonal Contraception NHS Cost-Effectiveness Calculations Can Choose to Ignore

What does “cost-effective” actually mean in contraception?

Cost-effectiveness sounds objective.

It sounds like somebody has taken every possible consequence, put it into a model, compared the alternatives and scientifically identified the best use of NHS money.

That is not necessarily what has happened.

An economic model is only as comprehensive as the outcomes and costs it has been designed to count.

If a model counts:

• the price of the contraceptive;
• the clinician's time;
• insertion and removal;
• contraceptive failure;
• and the cost of unintended pregnancy;

but does not count repeated treatment for side effects, sexual-health impacts, psychological distress, switching methods, repeated appointments, procedural trauma or the burden placed on the patient, then those things effectively have a value of zero inside the model.

That does not mean they cost nothing.

It means they were not counted.

What did the contraceptive economic modelling actually count?

This is where the history becomes particularly interesting.

The influential NICE economic work on Long-Acting Reversible Contraception was developed in the mid-2000s.

Its economic model compared IUDs, hormonal IUSs, implants and injections with the combined pill and permanent contraception.

It counted NHS costs including contraceptive provision, clinical time, equipment for insertion and removal, counselling, follow-up and costs associated with unintended pregnancy.

Those are legitimate costs.

But that was not a whole-life model of everything contraception might do to a person.

The principal outcome was prevention of unintended pregnancy.

It was not designed primarily to quantify libido, relationship quality, treatment burden, trauma, mental load or every medical consequence of side effects.

And remarkably, that modelling did not actually demonstrate that female sterilisation was economically inferior over the long term.

That is rather important when the patient asking for sterilisation is saying:

I do not want children. I do not want reversible contraception. I want permanent contraception for the rest of my reproductive life.

What did the Ombudsman find about the NHS cost argument in my case?

This is one of the strongest findings in the entire investigation.

The policy said female sterilisation was not normally funded partly because there were supposedly “more cost effective methods of contraception available.”

But the Parliamentary and Health Service Ombudsman found that the evidence considered by the commissioning committee did not demonstrate that conclusion.

The Ombudsman found that female sterilisation could actually be more cost-effective over longer periods of contraceptive use.

More importantly, the committee's own September 2017 material acknowledged that the available economic data largely considered direct costs and contraceptive-failure costs.

It did not adequately capture:

• indirect costs;
• wider societal costs;
• long-term consequences of unintended pregnancy;
• or the cost of managing hormonal-contraception side effects.

The Committee nevertheless used cost-effectiveness as part of the justification for restricting female sterilisation.

The Ombudsman ultimately concluded that the evidence had not been appropriately balanced.

This is why I find the word cost-effective so frustrating in this story.

They were making a cost argument without demonstrating that they had counted the real costs.

What costs did I raise in my original complaint?

When I complained in 2023, I deliberately challenged this narrow accounting.

I asked whether the NHS had considered not merely the acquisition price of contraception, but what decades of contraception could actually involve.

I raised:

• ongoing contraceptive costs;
• bleeding and menstrual problems;
• thrush and other symptoms;
• bloating and weight concerns;
• loss of libido;
• physical side effects;
• psychological and emotional effects;
• blood-clot and cancer risks associated with some hormonal methods;
• appointments to manage side effects;
• and even the possibility of additional mental-health treatment where contraception badly affects somebody's wellbeing.

I also made a deliberately simple financial comparison using retail contraceptive-pill prices over twenty years.

That was not intended as an NHS procurement calculation. It was a challenge:

if you are going to tell me that a one-off permanent procedure is too expensive, show me the actual lifetime calculation that proves it.

I never saw that calculation.

Why is the price of the contraceptive itself only the beginning?

Imagine two interventions.

Intervention A costs more today but is completed once.

Intervention B appears cheaper today but must be repeated, monitored, replaced or prescribed for decades.

You cannot sensibly compare them using only today's invoice.

For contraception, a proper long-term model may need to include:

• prescription costs;
• dispensing costs;
• GP and sexual-health appointments;
• contraceptive counselling;
• IUD and IUS insertion;
• implant insertion;
• device removal;
• replacement procedures;
• injections every few months;
• management of abnormal bleeding;
• investigation of pelvic pain;
• treatment of adverse effects;
• method switching;
• failed insertions or removals;
• contraceptive failure;
• emergency contraception;
• pregnancy and termination;
• and the healthcare consequences of any serious adverse event.

Then there are costs that are much harder to turn into pounds but still matter enormously to health.

What does irregular bleeding actually cost?

Bleeding changes are among the most common reasons people struggle with some contraceptive methods.

Hormonal IUSs can eventually make periods substantially lighter or stop them altogether, which can be a major health benefit for somebody with heavy menstrual bleeding.

But during the first months they can also cause irregular or prolonged bleeding.

Implants are also well known for unpredictable bleeding patterns.

Copper IUDs can make periods heavier and more painful.

For some people this is tolerable.

For others it is the reason they ask for the device to be removed.

From the healthcare-system perspective, troublesome bleeding can mean another appointment, assessment, medication, investigation, eventual removal and then another contraceptive consultation.

From the patient's perspective it can mean pain, disrupted sex, anxiety about bleeding, ruined clothing, sleep disruption and planning life around unpredictable symptoms.

Where is all of that in a simplistic “device cost versus sterilisation cost” calculation?

What does IUD insertion pain cost?

IUD and IUS insertion is sometimes described as a relatively straightforward procedure.

For many people it is.

For some it is not.

Current FSRH guidance recognises that pain during intrauterine-contraception insertion ranges from none to severe and says analgesia options should be discussed and offered.

Research repeatedly finds substantial variation.

For example, one prospective study reported an average insertion-pain score of around 6.6 out of 10 among women who had never been pregnant, compared with lower scores among women who had previously delivered vaginally.

A 2026 Australian national survey found that approximately one in five respondents reported severe pain during IUD insertion.

Another UK study found that clinicians tended to underestimate how much pain their patients were actually experiencing.

This does not mean IUDs are bad contraception.

They are safe, highly effective and excellent for many people.

It means insertion is a real healthcare experience, not an invisible line in a spreadsheet.

What about women with sexual trauma?

This deserves particular attention.

An IUD or IUS insertion involves a speculum being inserted into the vagina, access to the cervix and placement of a device through the cervix into the uterus.

For somebody with a history of sexual assault, invasive pelvic procedures may be particularly difficult or triggering.

Trauma-informed healthcare emphasises safety, control, consent, the ability to stop, clear explanation and avoiding re-traumatisation.

FSRH guidance now emphasises that patients should be encouraged to say when they are in pain or distress, should know that the procedure can be paused or stopped, and should have analgesia options discussed.

The research base specifically quantifying re-traumatisation during contraceptive insertion is still limited.

That is not a reason to pretend the issue does not exist.

It is a reason to research it properly.

What about mood and mental health?

This is an area where the science is more complicated than either side of the debate sometimes suggests.

Some large observational studies have found associations between hormonal contraception and depression or antidepressant use, particularly in some younger populations.

But randomised-trial evidence is much less clear.

A 2021 systematic review and network meta-analysis of randomised trials did not find evidence that hormonal contraception generally caused worsening depressive symptoms in adult women, although the authors described the certainty of evidence as very low and noted that first-time and younger users were underrepresented.

A 2024 systematic review found a more complex picture, including small increases in depression risk in some populations and differences by contraceptive type.

So the scientifically responsible conclusion is not:

Hormonal contraception makes women depressed.

Nor is it:

Mood effects do not exist.

The responsible conclusion is:

average effects are mixed, individual responses vary, some women report clinically important mood changes, and policy should be capable of responding to that variation.

And if someone repeatedly attends a GP because a contraceptive method is affecting her mood, switches medication, requires mental-health support or simply spends months feeling unlike herself, those consequences matter even if the average trial effect is small.

What about libido and sexual function?

Sexual health is another area that has historically received surprisingly little attention in contraceptive research.

The European Society of Sexual Medicine reviewed the evidence and concluded that hormonal contraception's effects on female sexuality remain controversial.

Most women do not experience major deterioration.

But a minority report changes in desire, lubrication, orgasm, arousal or relationship satisfaction.

That minority matters.

Research on IUDs and implants also suggests that how women perceive a method's effect on their sex life can strongly influence whether they continue using it.

In one prospective study, women who felt their IUD or implant had negatively affected their sexual experience were substantially more likely to discontinue it during the first year, although the number of discontinuations was small and the confidence interval was wide.

A small 2026 retrospective LARC study also found differences in sexual-function outcomes between copper IUD, hormonal IUS and implant users, with poorer scores in some domains among hormonal-IUS users. Because the study included only 90 women and the groups differed in some baseline characteristics, it should not be treated as definitive.

But taken together, the evidence tells us something important:

sexual wellbeing is a legitimate contraceptive outcome.

Why could libido loss create costs far beyond the bedroom?

Sexual desire exists inside relationships.

If somebody experiences a major change in libido, lubrication, pain, attraction or sexual satisfaction, the consequences may extend into intimacy, self-esteem and relationship satisfaction.

That does not mean contraception “causes divorce”.

The evidence absolutely does not justify that claim.

But it is equally unreasonable to pretend that sexual side effects have no social consequences simply because a cost-effectiveness model does not have a column labelled “relationship strain”.

Research on contraceptive sexual acceptability has found links between perceived negative sexual effects, dissatisfaction and discontinuation.

That can itself generate another chain of healthcare use:

sexual side effect → dissatisfaction → consultation → removal or switching → another prescription or procedure.

Even before we attempt to value relationship distress, there can therefore be direct NHS costs.

Can the pill change who women find attractive?

This is one of the most fascinating — and most easily overstated — areas of contraceptive research.

Earlier studies suggested that oral contraceptive use might alter some mate preferences.

One line of research examined the major histocompatibility complex, or MHC — genes involved in immune function.

Some early experiments suggested women might show odour preferences for genetically dissimilar men and that starting the contraceptive pill could shift those preferences toward greater similarity.

Other research suggested women who met partners while using oral contraception differed in sexual satisfaction, attraction or later relationship experience.

That created a striking hypothesis: could changing hormonal state after meeting a partner affect attraction?

But this is where good science requires restraint.

A comprehensive 2020 meta-analysis found no significant overall relationship between MHC dissimilarity and actual human mate choice, relationship satisfaction or odour preference.

A 2025 meta-analysis of the so-called contraceptive “congruency hypothesis” concluded that changing oral-contraceptive use was unlikely to have a substantial effect on partnered women's sexual satisfaction on average.

And a large 2026 study across 51 countries found no robust support for the idea that changing hormonal-contraceptive status after relationship formation substantially altered relationship quality.

There are still interesting unresolved questions here.

But I would not want NHS policy to be based on weak evolutionary speculation any more than I want it based on unsupported assumptions about female sterilisation regret.

The lesson is not that the pill destroys relationships. The lesson is that sexual and relational wellbeing are legitimate outcomes to research properly rather than dismiss or sensationalise.

Does hormonal contraception make the body think it is pregnant?

There is some truth underneath this common expression, but it needs to be explained carefully.

Hormonal contraception does not leave the body in its usual naturally cycling, non-pregnant state.

In a normal ovulatory cycle, hormones produced by the hypothalamus, pituitary gland and ovaries rise and fall in a coordinated pattern. Follicles develop, oestrogen rises, an LH surge triggers ovulation, and progesterone rises during the luteal phase.

Combined hormonal contraception deliberately interferes with that system.

The synthetic oestrogen and progestin provide negative feedback to the hypothalamic-pituitary-ovarian axis. FSH and LH are suppressed, ovarian follicular development is reduced and the LH surge that ordinarily triggers ovulation is usually prevented. Endogenous ovarian production of oestradiol and progesterone is therefore also altered.

In other words, the body is no longer operating in its ordinary cyclical reproductive state.

This is why hormonal-contraceptive treatment has historically sometimes been described as creating a “pseudo-pregnancy” state. There are similarities: ovulation is suppressed and sustained hormonal signalling replaces the normal cycle.

But the comparison should not be taken literally.

A real pregnancy involves implantation, production of hCG, maintenance of the corpus luteum and eventually a placenta producing very large quantities of hormones, alongside major cardiovascular, immune, metabolic and endocrine changes. Hormonal contraception does not reproduce that physiological state.

A more accurate description is that it creates a distinct pharmacologically induced endocrine state: neither a normal ovulatory menstrual cycle nor an actual pregnancy.

That distinction matters because the consequences of spending years in that altered hormonal state — including possible effects on mood, sexual function, bleeding, metabolism and other aspects of wellbeing — deserve to be researched rather than dismissed simply because the medication is effective at preventing pregnancy.

What about blood clots?

Some contraceptive methods carry small but real vascular risks. And the NHS states that combined hormonal contraception can increase the risk of blood clots.

For the combined pill, the NHS estimates the risk at up to around 1 in 1,000 users.

That is a low absolute risk.

But “low risk” and “zero cost” are not the same thing.

A serious clot can involve emergency care, hospitalisation, imaging, anticoagulation, follow-up and, in rare cases, permanent harm or death.

A proper whole-system economic model should at least determine whether such adverse events materially affect the comparison rather than automatically omit them.

What about cancer risk?

This also needs balance.

Hormonal contraception does not simply “cause cancer”.

Different methods alter different risks in different directions.

The NHS and Cancer Research UK report that combined oral contraception is associated with a small increase in breast-cancer risk and possibly cervical-cancer risk while being associated with lower risks of ovarian and endometrial cancer, with some evidence of reduced bowel-cancer risk too.

The excess breast and cervical risks reduce after stopping.

So this is not a simple argument against hormonal contraception.

It is an argument against pretending that every contraceptive option is medically interchangeable.

Different women have different family histories, cardiovascular risks, bleeding problems, cancer risks, reproductive plans and preferences.

“What is healthiest?” cannot be answered by one commissioning committee for every woman.

What about bone health?

Depot medroxyprogesterone contraceptive injections are another example of why method-specific consequences matter.

The NHS states that prolonged use can reduce bone mineral density, although bone density usually recovers after stopping.

The method can also involve weight gain, menstrual changes and repeat injections every eight to thirteen weeks.

For somebody who likes the method, those trade-offs may be entirely worthwhile.

For somebody who wants permanent contraception and has no desire to retain fertility, repeatedly receiving injections for years may make far less sense.

What does the mental load of contraception cost?

Some contraceptive methods have another characteristic that economic models struggle to capture:

the patient has to keep doing something.

The pill must be remembered every day.

Patches must be replaced.

Rings must be managed.

Injections must be repeated.

Devices eventually need replacement or removal.

This is not merely convenience.

Studies using electronic monitoring repeatedly find that people miss more pills than they report remembering.

Research also shows that stress and hectic daily life contribute to missed pills.

That means the cognitive burden of contraception can affect its real-world effectiveness.

For somebody who knows with certainty that she never wants to become pregnant, permanent contraception removes that recurring cognitive task.

While that benefit may be difficult to capture in monetary terms - it is not worthless.

Does method switching matter economically?

Very much.

A method can look inexpensive if an economic model assumes somebody starts it and keeps using it.

Real life is messier.

People discontinue because of:

• bleeding;
• pain;
• sexual effects;
• mood concerns;
• acne;
• weight concerns;
• desire for pregnancy;
• or simply disliking the method.

Every switch can involve appointments, counselling, prescriptions, removal, another insertion and another period of adjustment - which goes from weeks to months at a time. Now imagine having to go through 3 different methods before you find one that works for you - that is easily a year before you land on something that works for your body and lifestyle.

The research confirms method-switching is a common, recurring part of contraceptive use driven mainly by side-effect-driven dissatisfaction, and that some women go through several methods over their reproductive years before finding one that works — but no study in this retrieved literature reports a standardized average "number of methods tried before success." That specific metric appears to be a genuine gap in the literature; what exists is rates and predictors of switching rather than a count of attempts per woman.

Indeed, discontinuation was one of the major variables determining cost-effectiveness in the original NICE LARC modelling.

This makes patient preference economically relevant as well as ethically relevant.

A contraceptive somebody hates and rapidly removes may be less cost-effective than a supposedly more expensive option she actually wants.

What does female sterilisation cost — and what does it avoid?

Female sterilisation is not risk-free.

It requires surgery, usually under general anaesthetic.

The NHS identifies possible complications including infection, blood clots, injury to nearby organs or blood vessels and an increased risk of ectopic pregnancy if the sterilisation fails.

Those risks belong in any honest comparison.

But sterilisation also has characteristics that matter enormously for somebody who does not want future fertility.

It is more than 99% effective.

It is permanent.

It does not alter hormone levels.

After recovery, it does not require another pill every day, an injection every few months or a device replacement every few years.

So the comparison should never be:

“surgery has risks; LARC therefore wins.”

The comparison should be:

What are the total benefits, risks, burdens and costs of each realistic option for this particular patient over the period for which she actually needs contraception?

So what is the healthiest contraceptive method?

There is no universal answer.

And I think that is precisely the point NHS policy has repeatedly missed.

An IUS may be one of the healthiest options for a woman with very heavy painful periods who also wants reversible contraception.

A copper IUD may be preferable for somebody who wants highly effective contraception without hormones.

The pill may suit somebody perfectly.

An implant may remove the burden of daily adherence.

A vasectomy may be the simplest permanent choice for a couple.

And for an adult woman who is certain she does not want future fertility, understands that sterilisation is permanent and accepts its surgical risks, female sterilisation may be the option that best fits her health, values and life.

Evidence-based medicine should help people make that decision. It should not make the decision for them.

What would genuinely evidence-based contraceptive commissioning look like?

If I were designing the policy-analysis framework I expected the NHS to have used, it would not begin with:

Which method costs us the least this year?

It would begin with:

What outcomes matter to patients, what does the best evidence show, and what is the full cost of providing safe and equitable care over time?

A serious model should examine:

• contraceptive effectiveness in both perfect and real-world use;
• time horizon — one year, five years, ten years, twenty years and remaining reproductive life;
• direct treatment costs including drugs, devices, surgery and professional time;
• repeat healthcare use including prescribing, insertions, removals, replacements and follow-up;
• adverse events and side-effect management;
• method switching and discontinuation;
• pain and procedural burden;
• mental-health outcomes where evidence supports inclusion;
• sexual function and sexual wellbeing;
• quality of life;
• contraceptive mental load and adherence;
• unintended pregnancy, emergency contraception and termination;
• patient time and travel;
• waiting times and service capacity;
• trauma-informed care needs;
• patient preference;
• sex-based equality;
• geographical inequality;
• and the consequences of denying or delaying the patient's preferred method.

Some of those outcomes can be assessed in monetary terms.

Some belong in quality-adjusted-life-year analysis.

Some are better represented through patient-reported outcome measures.

Some may remain qualitative.

But difficult to price should never silently be treated as if it has zero worth.

Why is this also a human-rights and equality issue?

Healthcare economics does not exist outside the NHS's other responsibilities. The NHS Constitution says care should reflect individual needs and preferences. Patients have rights to information about available treatment options, their benefits and their risks. They have rights to involvement in decisions about their healthcare.

The NHS must respect human rights, promote equality and have regard to reducing inequalities in both access and outcomes.

That matters particularly in contraception because the intervention happens to somebody's body for the explicit purpose of controlling their reproductive capacity.

Cost matters. But it cannot be the only value in the room.

Why does the male vasectomy comparison make this harder to defend?

There is another economic question that I still do not think has been adequately answered.

Why is permanent contraception being treated differently depending on whose body requires it?

The original Ombudsman investigation found that the Committee did not handle comparable questions about male and female sterilisation consistently.

Later, I found NHS-funded vasectomy being delivered through private providers and, in some areas, direct self-referral pathways.

You can read that investigation in The Gender Gap in Healthcare: The Vasectomy Pathway NHS Thames Valley Would Not Explain.

If commissioners are willing to pay for permanent contraception for men and improve the convenience of accessing it, while simultaneously treating permanent contraception for women as something to defer in favour of decades of alternatives, the equality analysis needs to be exceptionally strong.

I have not seen evidence that it ever was.

Is the healthcare postcode lottery finally changing?

There is one wider NHS reform that could create an opportunity to do this better.

England's commissioning structure is currently being reorganised.

Integrated Care Boards are being merged into fewer, larger organisations, partly to reduce administrative costs and duplication. NHS England's Strategic Commissioning Framework says the number is expected to reduce from 42 to around 26.

The government's 10 Year Health Plan also envisages ICBs becoming much more focused strategic commissioners, supported by a national commissioning framework, shared benchmarking and the ability to commission services at larger scale.

That could help reduce the kind of postcode lottery my case exposed.

But it is important to describe the reform accurately.

The NHS is not simply moving toward one national policy for every treatment.

The current model still gives ICBs substantial responsibility for local commissioning and explicitly talks about local autonomy.

So consolidation alone will not solve variation.

Could the NHS have national minimum standards without nationalising every service?

Yes.

And the NHS already does versions of this.

Specialised services can be locally or regionally delivered while still being governed by consistent national service specifications and evidence-based policies intended to provide equivalent access regardless of geography.

There is no obvious reason that the NHS could not establish stronger national minimum standards for other rights-sensitive services.

For permanent contraception, that could mean:

• a national evidence base;
• a national minimum access standard;
• consistent principles for informed consent;
• no mandatory trial of another contraceptive purely because of geography;
• national equality requirements;
• transparent criteria for any local departure;
• and referral to another NHS provider if the procedure is not available locally.

The hospital performing the surgery does not have to be in every town.

The patient's right to fair access does not therefore need to disappear at the county border.

What is interesting about the NHS's own new commissioning framework?

The irony is that NHS England's new Strategic Commissioning Framework describes almost exactly the kind of process I expected to see in this case.

It describes strategic commissioning as a continuous evidence-based process.

It says commissioners should understand population need, examine access, costs, capacity, waiting times, quality and outcomes, gather feedback from people using services and incorporate lived experience into decisions.

It also says commissioning should improve population health, reduce inequalities and improve equitable access to consistently high-quality care.

That sounds excellent.

But policies are not evidence-based because the framework says they should be.

The evidence has to actually be there.

The balancing has to actually happen.

The patients have to actually be heard.

What has troubled me throughout this entire case?

I keep coming back to the same problem.

Where is the evidence?

When I asked what evidence supported the claim about female sterilisation regret, I did not receive a convincing answer.

When I asked how bodily autonomy had been considered, the answer was inadequate.

When I challenged the cost-effectiveness rationale, the independent investigation later found that the evidence had not been appropriately balanced.

When I asked about equality with male sterilisation, the Ombudsman found that comparable circumstances had not been handled consistently.

When the policy was rewritten after the Ombudsman investigation, another restriction on women appeared — the requirement for a 'therapeutic trial' of LARC.

I then asked Chair Dr Priya Singh to explain the legal, clinical and evidential basis for that restriction - I never received the clear answer I asked for.

You can read that correspondence in Why NHS Chair Dr Priya Singh Couldn't Defend the February 2026 Female Sterilisation Policy.

Why does this feel bigger than one contraception policy?

Because this is what concerns me about healthcare policymaking generally.

A policy can look beautifully professional.

It can contain references to evidence-based care, equality, patient choice, safety, affordability and good governance.

But the important question is not what the policy says about itself.

The important question is:

In my experience of this case, again and again, I have found impressive language describing how policy should be made and an astonishing lack of documentary evidence demonstrating that those standards were actually followed.

What would I want the NHS to do differently?

I do not want an NHS that automatically promotes sterilisation.

I do not want an NHS that automatically promotes LARC.

I do not want an NHS that promotes the pill.

I want an NHS that does the difficult thing:

genuinely compares the options.

Compare their effectiveness.

Compare their risks.

Compare their burdens.

Compare their actual lifetime costs.

Study sexual wellbeing.

Study mood properly.

Study pain.

Study discontinuation.

Study trauma.

Study why women switch.

Study how much repeat healthcare those switches generate.

Study equality.

Study patient preference.

Then give people accurate information and let competent adults decide what trade-offs make sense for their own bodies.

Two Vasectomy Pathways FOIs Later: Will NHS Thames Valley ICB Finally Show the Evidence?

Why am I asking about NHS-funded vasectomy again?

This follows directly from my previous investigation into the difference between access to male and female permanent contraception.

I discovered that NHS-funded vasectomy services can be delivered through private or independent providers and that direct-access or self-referral arrangements have existed or been developed for men.

At the same time, women seeking permanent contraception have faced a very different history of restrictions, approval requirements and contraceptive gatekeeping.

I wanted to know how that difference had been commissioned, governed and equality-assessed.

You can read the full background here:

What happened to the first vasectomy FOI?

My first request, TV-2607-192, was deliberately broad because I wanted to understand the commissioning history, providers, referral pathways, safeguards and equality assessment surrounding NHS-funded vasectomy.

NHS Thames Valley ICB refused it under Section 12 of the Freedom of Information Act, saying the work required would exceed the statutory cost limit.

I then asked the ICB to fulfil its duty under Section 16 and help me formulate a narrower request that it could answer.

I dramatically reduced what I was asking for.

The ICB nevertheless said it could identify no meaningful refinement.

So I did the refining myself.

How narrow is the second FOI?

On 3 September 2026, I submitted a completely new Freedom of Information request.

I expressly removed:

• historic and expired vasectomy arrangements;
• previous providers;
• historical pathway versions;
• procurement history;
• historic correspondence;
• the original search back to 2017;
• and any request for the ICB to create a new analysis.

I am now asking for only two categories of existing records.

First: the current documents showing how patients presently access NHS-funded vasectomy under relevant former BOB ICB arrangements that remain operative, and any genuinely new Thames Valley-wide arrangements.

Second: the current or most recent recorded evidence showing how equality duties were considered when those arrangements were commissioned, continued or adopted.

That includes NHS-funded services delivered through private or independent providers.

If no equality evidence exists, I have simply asked the ICB to say so.

Why does the equality evidence matter?

Because this is not just a question about where men book a vasectomy.

The underlying question is whether NHS Thames Valley ICB has properly considered the difference between how men and women access permanent contraception.

If men can receive NHS-funded permanent contraception through comparatively straightforward private-provider pathways while women have historically been subjected to substantially more gatekeeping, then I want to see the evidence showing how that difference was assessed.

Not another reassurance.

The records.

Even the acknowledgement had to be chased

The new request was submitted on 3 September 2026.

Seven days later, on 10 September 2026, I still had no acknowledgement and no reference number.

So I chased it.

On 12 September 2026, NHS Thames Valley ICB finally confirmed that the request had been logged and gave it the reference:

The late acknowledgement does not restart the statutory clock.

The request was submitted on 3 September.

When does NHS Thames Valley ICB have to respond?

Under the Freedom of Information Act, public authorities ordinarily have to respond promptly and no later than the twentieth working day following receipt of a valid request.

For this request, that gives NHS Thames Valley ICB a statutory deadline of:

So what am I waiting to see?

At this point, the test is very simple.

I want to see whether NHS Thames Valley ICB will:

1. meet the statutory deadline;
2. provide the current vasectomy pathway documents;
3. provide the equality evidence it holds;
4. clearly confirm if particular records do not exist;
5. and provide a substantive response rather than creating another transparency battle.

The original request was broad.

This one is not.

I have reduced it to the records that should be closest to hand if NHS Thames Valley ICB is currently commissioning, funding or administering these services.

So this time, I am leaving the question here publicly before the deadline passes.

What happens next?

I am not going to keep expanding this post every time another email arrives.

This is simply a marker of where the investigation stands now.

When NHS Thames Valley ICB responds — or if the statutory deadline passes without a lawful response — I will publish the next part separately.

That way, there is a clear public record of what I asked, when I asked it and what the ICB was required to do next.

You can follow the wider chronology on The Timeline, and the underlying correspondence is available through my Evidence Folder.

Men Can Self-Refer. Why Can’t Women? And cheers to another failed FOI Request, and the mystery continues!

A note about my conclusions: I believe the difference between the male and female pathways raises a serious equality problem, and I believe the ICB has repeatedly obstructed transparency around how those differences are justified. This is my opinion. Please review the evidence yourself and make your own.

Why did the vasectomy pathway immediately raise an equality question for me?

By spring 2026, I was already challenging NHS Thames Valley ICB about the way women seeking permanent contraception were still being treated.

The latest female sterilisation policy continued to impose conditions on women’s access.

Women were still navigating NHS pathways where clinicians, referral criteria, contraceptive alternatives and organisational policy all sat between the woman and the permanent contraception she had chosen.

Then I found the male pathway.

The screenshot I took from Thames Valley Vasectomy Services showed an NHS-funded vasectomy service delivered by a private provider.

The page said patients registered with GP practices in both Frimley ICB and BOB ICB areas were eligible for NHS-funded vasectomy.

It also said:

For Frimley patients, the page stated that men could refer themselves directly.

For BOB patients, it said the provider was working with the ICB to expand self-referral access.

That got my attention immediately.

If men can bypass the GP, why are women still being gatekept?

This is the question at the heart of the whole issue for me.

Men seeking permanent contraception appeared to have access to something women did not:

• a private provider;
• NHS funding;
• direct-access pathways;
• and, in some areas, self-referral without a GP.

I have not found an equivalent private, NHS-funded, self-referral route for women seeking sterilisation.

And that is the problem.

I am not claiming that vasectomy and female sterilisation are clinically identical.

They are not.

But equality does not require pretending two procedures are medically identical.

It requires asking whether the difference in access is necessary, proportionate and actually justified by evidence.

That is what I wanted the ICB to show me.

Why did I ask Chair Dr Priya Singh to explain the male vasectomy pathway?

During my correspondence with Dr Priya Singh in June 2026, I raised the growing disparity directly.

I challenged the fact that women seeking sterilisation were still being subjected to restrictive pathways while NHS-funded vasectomy services appeared to be expanding access through private provision and self-referral.

I wanted to know how the ICB justified that difference.

Was there an Equality Impact Assessment?

Had the male and female pathways actually been compared?

Had anyone examined whether making vasectomy easier to access while female sterilisation remained harder created or worsened sex-based inequality?

Had anyone considered extending comparable access to women?

I did not get a substantive answer.

So, once again, I moved from asking for explanations to asking for the records.

What exactly did I ask for in FOI TV-2607-192?

On 24 July 2026, I submitted a Freedom of Information request titled:

Commissioning, Procurement and Equality Assessment of NHS-Funded Vasectomy Services.

The request covered NHS-funded vasectomy services across the current NHS Thames Valley ICB area and predecessor organisations from 1 January 2017 onward. It expressly included private and independent providers and direct-access or self-referral pathways.

I asked for four main categories of evidence.

• Who was commissioned — NHS providers, private clinics and independent providers, contract dates, areas covered and service specifications.
• How men accessed the service — GP referral, direct booking, self-referral, eligibility, consent, counselling, refusal criteria and prior approval.
• What equality work had been done — Equality Impact Assessments, PSED assessments and any recorded comparison between vasectomy and female sterilisation.
• Whether equivalent access for women had ever been considered — including self-referral, NHS-funded private provision and allowing the treating clinician’s consent and capacity assessment to determine access without another ICB approval layer.

I also specifically asked how the ICB assured itself that men self-referring into private clinics were being properly assessed for eligibility, capacity and informed consent.

That is important.

If men can self-refer into private clinics, what safeguards actually apply?

At the moment, I still do not know.

That was one of the reasons for the FOI.

I wanted to see the clinical-governance, safeguarding, audit and monitoring requirements attached to these privately delivered NHS services.

• What does the assessment look like?
• Who checks capacity?
• Who discusses permanence and regret?
• What information does the man receive?
• What are the refusal criteria?
• Does anybody require him to try another contraceptive method first?
• Does anybody ask whether he has children?
• Does anybody ask whether his future partner may want children?
• Does the ICB itself approve anything?

Or is the system basically:

That latter model would actually make sense to me.

What does not make sense is offering that kind of autonomy to men while treating women as though permanent contraception requires institutional permission.

And because the ICB refused to disclose the records, I still cannot tell you exactly where the safeguards sit.

For all I know from the information disclosed so far, men may be receiving appropriate counselling and robust clinical assessment.

Or the private provider may be doing little more than checking eligibility, giving information and proceeding.

I do not know — because the ICB has not shown me the records.

And that uncertainty is precisely why transparency matters.

Why does private NHS-funded access matter so much in the equality comparison?

Because private provision changes the patient experience.

Private clinics are often structured around speed, direct booking and convenience.

The screenshot itself advertises vasectomy access with “minimum fuss”.

That is a very different message from the one women receive.

Women seeking sterilisation are asked to navigate clinical pathways, contraceptive alternatives, referrals and eligibility criteria in a system where access itself has repeatedly been questioned.

Even where a woman is eventually approved, the actual operation is still likely to sit within an NHS surgical pathway, with the waiting times and capacity pressures that come with that.

So there are potentially two layers of inequality here:

Where is the equivalent provision for women?

I have not found it.

Why did I have to chase even the acknowledgement of the vasectomy FOI?

The request was submitted on 24 July 2026.

By 30 July 2026, I still had not received a proper acknowledgement, reference number or confirmation that the request had been registered.

So I chased.

I specifically asked for:

• confirmation that the request had been received;
• the assigned reference number;
• and the name, position and department of the person or team responsible for it.

The reply told me the reference was TV-2607-192, but also said:

That answer bothers me more than it may bother other people.

Because throughout this entire case - all the way back to my original complaint to today, I have repeatedly had to ask:

• Who am I actually dealing with?
• Who made this decision?
• Who approved it?
• Who is accountable for it?

And again and again, correspondence arrives from generic teams and generic job labels.

That makes accountability incredibly easy to lose.

Why does refusing to identify officials make accountability harder?

Large organisations already diffuse responsibility naturally.

A request moves between teams.

A policy moves through committees.

An email is drafted by one person and authorised by another.

A decision is described as “the ICB’s position”.

Then, months later, when you ask who actually did what, nobody seems to own it.

This is exactly why I think public officials exercising power should be identifiable in their official roles.

I am not asking for private phone numbers, home addresses or personal information.

I am asking:

Who acted on behalf of a public organisation?

If nobody can tell me that, then accountability becomes almost impossible.

Why did I warn the ICB before the deadline that I did not want another last-minute failure?

The statutory deadline for TV-2607-192 was 21 August 2026.

After what had already happened with my previous FOI request, I was not prepared to simply wait until the deadline and discover that nothing had been done.

So on 17 August 2026, I contacted the FOI team proactively.

I asked whether the request was on track.

I asked whether all relevant teams had been contacted.

I asked whether any issue existed that might prevent a complete response by 21 August 2026.

I explicitly said I did not want to discover after the deadline that the request had again not been progressed appropriately.

Then came the final response.

Why did NHS Thames Valley ICB refuse the entire vasectomy FOI?

At the very end of the statutory period, the ICB refused the request under Section 12 of the Freedom of Information Act.

Section 12 allows a public authority to refuse a request where it reasonably estimates that the cost of locating, retrieving and extracting the information would exceed the statutory limit.

The ICB said it had carried out an initial scoping exercise taking 10 hours.

It identified relevant records across:

• seven business functions;
• six directorates;
• multiple predecessor organisations;
• historical commissioning records;
• procurement;
• contracts;
• finance;
• quality;
• corporate governance;
• and equality functions.

The ICB therefore said the full request would exceed the 18-hour cost limit and refused it in its entirety.

I can understand why a nine-year, 25-part request might exceed the cost limit.

That is not actually the part that bothers me most.

The next part does.

If the ICB had already mapped the records, why couldn’t it help me narrow the request?

The response said the ICB had considered whether the request could be narrowed by:

• reducing the time period;
• limiting it to current commissioning arrangements;
• restricting it to a particular category of records;
• restricting it to a particular provider or contract;
• or excluding predecessor organisations.

Then it concluded that it could identify no meaningful refinement that would bring the work under the cost limit.

I did not accept that.

Because by its own account, the ICB had already spent 10 hours working out:

where the information was, which departments held it, what kinds of records existed and which organisations were involved.

That put the ICB in a vastly better position than me to say:

If you ask only for X, Y and Z, we can answer it.

So I asked them to do exactly that.

What does Section 16 actually require public bodies to do?

Section 16 of the Freedom of Information Act creates a legal duty to provide reasonable advice and assistance.

The Information Commissioner’s guidance says that where Section 12 applies, a public authority should first consider whether there is information it can provide within the cost limit.

It should then consider whether it can help the applicant refine or refocus the request.

The ICO specifically says that simply telling somebody to “narrow” a request without indicating what could actually be provided may just lead to another failed request.

The Upper Tribunal has described Section 16 as requiring an authority to suggest obvious alternative formulations capable of providing the core information within the cost limit.

That is exactly what I asked NHS Thames Valley ICB to do.

How much further did I narrow the request myself?

On 21 August 2026, I wrote back and stripped the request down dramatically.

I told them I was prepared to drop:

• expired historical contracts;
• the wider nine-year historical search;
• most predecessor organisations;
• historic pathway versions;
• historic procurement exercises;
• and most of the original 25 questions.

I reduced my core priorities to four things:

1. Who currently provides NHS-funded vasectomy?
2. What is the current access and referral pathway?
3. What is the current or latest equality assessment?
4. What is the current or latest recorded comparison with female sterilisation?

I even asked them:

If all four are still too much, tell me which ones you can provide.

And if even that was too broad, tell me what obvious further refinement would work.

I was trying to cooperate with them.

Why did I have to chase the Section 16 help too?

Because they did not answer.

On 28 August 2026, seven days later, I chased again.

I reminded them that I was not asking them to reconsider the original FOI.

I was asking for the advice needed to formulate a new request that would actually succeed.

I again asked them to tell me what current information, or combination of categories, they could reasonably provide.

Then, on 2 September 2026, I finally received their answer.

It was basically:

That is the point where, in my view, the ICB stopped merely relying on Section 12 and started failing its Section 16 responsibility.

The ICO may ultimately decide whether that amounted to a legal breach.

I think it did.

How can there be no workable refinement when I was asking for current providers and one current pathway?

This is what I still cannot understand.

We are talking about a service the ICB is currently commissioning.

Surely somebody knows:

• who is currently being paid to deliver it;
• what service specification applies;
• how patients are referred;
• what current eligibility criteria apply;
• and whether an equality assessment exists.

If NHS Thames Valley ICB genuinely cannot retrieve even that basic current information within 18 hours, then to me that raises an entirely different governance problem.

How do you oversee a commissioned service if you cannot efficiently identify its current provider, pathway or equality documentation?

Why did I escalate the Section 16 refusal to Dr Nick Broughton and Dr Priya Singh?

On 3 September 2026, I stopped debating the point with the anonymous Information Governance Officer.

I copied in:

• Dr Nick Broughton, Chief Executive and Accountable Officer;
• Dr Priya Singh, Chair;
• and Hannah Iqbal, Chief Strategy and Commissioning Officer.

I told them directly that I regarded the refusal to provide meaningful Section 16 assistance as another organisational failure.

I also made clear that I was copying senior leadership deliberately. Not because I expected a miracle. But because I wanted there to be no later suggestion that they did not know what was happening.

I heard nothing from Dr Singh.

I heard nothing from Dr Broughton.

Once again - breaches in FOI guidelines and I saw no evidence of senior intervention.

Why does Dr Nick Broughton’s role as Accountable Officer matter again?

Why am I so bothered that the FOI team refuses to give names?

Because this entire case has taught me how easily responsibility disappears inside a large institution.

The vasectomy FOI response did not come from a named officer.

It came from:

“Information Governance Officer.”

When I asked for the name and position of the person handling the request, I was told the ICB does not give names because requests may be handled by multiple people.

I think that is a terrible approach to public accountability.

• Who drafted the refusal?
• Who approved the Section 12 estimate?
• Who decided there was no meaningful Section 16 refinement?
• Who checked that decision?
• Who was responsible for escalating it?
• Who signed it off?

If nobody is named, how does anybody later reconstruct what actually happened?

And if nobody can reconstruct what happened, how does anyone get held accountable?

Does easier male access automatically prove unlawful inequality?

No.

There may be legitimate clinical reasons why vasectomy and female sterilisation are commissioned differently.

Vasectomy is generally simpler, less invasive and cheaper.

But those facts do not answer every equality question.

They do not automatically explain:

• why men may self-refer while women cannot;
• why private NHS-funded provision is apparently available to men but not women;
• why women have historically faced prior-approval and exceptional-funding hurdles;
• why women may be pushed towards reversible contraception before permanent contraception;
• or whether anybody actually performed a proper equality assessment before expanding male access.

That is exactly why I asked for the records.

What does equal healthcare actually require here?

Equal healthcare does not mean giving men and women identical operations.

It means that where the NHS creates easier access for one sex to permanent contraception, it should be able to explain why comparable access cannot or should not be offered to the other.

It should be able to show:

• the clinical evidence;
• the commissioning rationale;
• the equality assessment;
• the safeguards;
• the patient experience;
• and the proportionality of the different pathways.

So far, I have not been shown that analysis.

Instead, when I asked for it, I got a refusal based on cost.

Then, when I asked them to help me narrow the request, I got told there was no meaningful way to do so.

Why does this feel like transparency is being obstructed around male commissioning?

Because this is not obscure historical trivia.

I am asking how an NHS-funded service for men is currently commissioned.

I am asking how private providers are selected and governed.

I am asking what safeguards exist.

I am asking what equality analysis exists.

I am asking whether women were ever considered for comparable access.

Those are basic public-interest questions.

And instead of getting a clear audit trail, I have had to fight through:

• an unacknowledged request;
• a last-minute Section 12 refusal;
• a refusal to identify the officials handling it;
• a separate request for Section 16 help;
• another delay;
• and then a flat statement that there was no meaningful refinement they could suggest.

To me, that is obstructive.

And because this information directly relates to whether men are receiving easier access to permanent contraception than women, I find the lack of transparency even more concerning.

Why does the difference in patient experience matter as much as the formal policy?

Because healthcare inequality is not only about whether two services technically exist.

It is also about how difficult they are to access.

A man who can self-refer to a private NHS-funded clinic may experience:

• direct booking;
• shorter administrative routes;
• private-provider efficiency;
• fewer gatekeepers;
• and quicker progression to treatment.

A woman seeking sterilisation may experience:

• GP referral;
• specialist referral;
• discussion of alternative contraception;
• policy criteria;
• possible approval hurdles;
• and then an NHS surgical waiting list.

Even before we compare the operations themselves, the pathway can create a huge difference in practical access.

That is healthcare inequality in real life.

Why do I describe the current system as favouring men’s reproductive choices?

Because from what I can currently see, a man can say:

I do not want children. I want permanent contraception.

And the system appears capable of building convenient NHS-funded access around that decision.

For women, the system has spent years asking whether we might regret it, whether we should try something else first, whether our circumstances are exceptional enough, and whether the NHS should fund the decision at all.

That is not a small difference.

It sends a cultural message too:

I think that is deeply unequal.

What did I do after NHS Thames Valley ICB refused to help me narrow the request?

I stopped arguing with them.

On 3 September 2026, I told the ICB that I would submit a new and substantially narrower request.

The ICO guidance is clear that a refined request is treated as a new request, with a fresh statutory response period, and the costs of the original request cannot simply be aggregated with it.

So I stripped the scope right down.

The new request is deliberately minuscule compared with the original one.

I have removed the broad historical search.

I have removed the 25-part structure.

I have narrowed it to the core current information I actually need.

And even then, the first thing that happened was familiar.

I did not receive a prompt acknowledgement and case reference.

So I had to chase again.

What does even the failure to acknowledge a tiny new FOI tell me?

On its own, not much.

Inside this history, quite a lot.

Because this is now a recurring environment.

I submit a request.

I wait.

I chase acknowledgment.

I ask for a reference.

I ask who is handling it.

I get a generic team response.

I wait until the deadline.

I challenge the result.

I ask senior leadership to intervene.

Nothing changes.

At some point, repeated process failure stops feeling accidental. It starts looking like how the system works under its current Leadership of CEO Nick Broughton.

What am I trying to establish with the new narrowed vasectomy FOI?

The new request is designed to strip away every excuse.

I want the core evidence necessary to answer a few basic questions:

• Who is currently commissioned to provide NHS-funded vasectomy?
• What is the current approved access and referral pathway?
• What current equality assessment applies?
• And has anyone actually compared that pathway with female sterilisation?

If NHS Thames Valley ICB cannot answer even that without another refusal, delay or transparency battle, then that in itself will tell us something important about the state of its commissioning records and accountability systems.

Why am I going to keep comparing vasectomy with female sterilisation?

Because this comparison goes to the heart of everything I have been challenging since 2022.

Permanent contraception should be about informed adult choice.

If the NHS believes men can make that choice through a straightforward, even privately delivered, NHS-funded pathway, then it needs to explain why women cannot be given something comparably respectful of their autonomy.

Not identical surgery.

Not identical clinical pathways.

Comparable respect for the decision.

That is what I have been asking for all along.

Where can I read the vasectomy FOI evidence?

You can read the original vasectomy FOI, the Section 12 refusal, my Section 16 request for help narrowing it, the ICB’s refusal to provide further assistance, and the later correspondence with senior leadership in my Evidence Folder.

The NHS CEO, Dr Nick Broughton, Said the Female Sterilisation Policy Was Robust. The Ombudsman Found Something Very Different

What exactly did the Chief Executive Dr Nick Broughton tell me?

BOB ICB's final response did not concede that something fundamental might have gone wrong with the female sterilisation policy.

Instead, it defended the process.

Chief Executive Dr Nick Broughton told me that the Thames Valley Priorities Committee had fully reviewed the policy and that the process included:

His letter also stated that policy recommendations were approved and adopted through a "robust governance process".

Those are strong assurances.

They invite the reader to believe that the NHS had properly gathered the relevant evidence, weighed it rationally, considered equality and ethics, followed proper governance, and arrived at a defensible policy.

The Ombudsman's investigation tells a very different story.

Did the NHS properly balance the evidence on female sterilisation regret?

The CEO's response: the policy had been through a full assessment of evidence, guidance and ethical considerations.

The Ombudsman's provisional finding: the evidence on regret had not been appropriately balanced.

The underlying papers themselves acknowledged that regret was subjective and difficult to quantify. Research showed wide variations in reported regret, dependent on circumstances and risk factors.

The evidence considered in relation to male sterilisation also said regret following sterilisation was experienced by a minority of people.

Yet female sterilisation policy was built around the idea of significant or substantial regret.

The Ombudsman found no adequate explanation for turning such a subjective measure into an objective commissioning barrier.

More importantly, it found that the committee had not given sufficient weight to informed consent and the Mental Capacity Act principle that an adult with capacity should not be treated as incapable of making a decision simply because somebody else thinks it is unwise.

The Ombudsman considered that comparable circumstances affecting men and women had not been handled fairly or consistently.

Were other contraceptives really shown to be more cost-effective?

This was one of the things that infuriated me from the beginning because the NHS's own papers appeared to contradict its policy.

The female sterilisation policy stated that other, more cost-effective contraceptive methods were available.

Yet evidence before the committee indicated that female sterilisation could become more cost-effective than LARC after six years in one study, and that male and female sterilisation were more cost-effective than LARC over 15 years in other modelling.

The Ombudsman's provisional view was remarkably clear: the committee had not demonstrated that alternative contraception was more cost-effective than female sterilisation.

It described the policy wording as appearing illogical given the evidence actually available.

It also identified something I had raised in my original complaint: the calculations had not properly dealt with wider costs, including the cost of side effects, alternative contraception, terminations and unintended pregnancies.

Even more strikingly, some of those broader costs had been considered when discussing whether male sterilisation should continue to be funded.

They had not been treated in the same way when deciding whether women should retain access to sterilisation.

Did the NHS properly consider the risks and side effects of forcing women towards other contraception?

The CEO's response told me clinicians could discuss the risks and benefits of the contraceptive options available.

But my challenge had never been whether clinicians were capable of explaining contraception.

My question was whether the policy itself had properly balanced those risks before making sterilisation unavailable except through an exceptional-funding route.

The Ombudsman found significant gaps.

The evidence considered by the NHS included recognised side effects and risks associated with other forms of contraception. Later records also showed women coming through the Individual Funding Request route because they had exhausted other contraceptive options through side effects such as low mood and weight gain or because of health risks.

By November 2021, the NHS itself was being asked to consider whether certain groups of women — including those unable to tolerate other contraception — should have access to sterilisation.

Yet the Ombudsman could find no proper record showing that this work had been completed and rationally fed back into the policy.

The action was simply marked complete.

The policy stayed essentially the same.

Was female sterilisation actually subjected to the consultation the NHS's own advisers said was needed?

This may be one of the clearest mismatches of all.

Before the policy was implemented, specialist advisers in ethics and health law had reportedly warned that withdrawing an NHS service represented a significant change and should be consulted upon.

They also recommended that male and female sterilisation should be considered together in the interests of fairness and consistency.

I specifically asked BOB ICB whether that consultation had happened.

The Chief Executive's response told me the process had included legal and ethical considerations.

It did not answer the consultation question.

The Ombudsman did.

The Ombudsman described that as a significant omission.

This matters because "we considered ethics" is not remotely the same thing as following ethical advice.

Did the policy treat women and men fairly?

The ICB had repeatedly pointed to differences between vasectomy and female sterilisation. Those differences are real. Vasectomy is generally simpler, cheaper and less invasive.

But that was not the whole equality question.

The Ombudsman found that the NHS had approached comparable issues in fundamentally different ways.

Both men and women can regret sterilisation.

Men were offered counselling about that risk.

Women faced restricted access partly because of that risk.

When considering the consequences of withdrawing vasectomy, the NHS looked at wider effects such as increased use of other contraception, emergency contraception, terminations and birth rates.

The Ombudsman found that equivalent considerations were not properly weighed when female sterilisation was restricted.

And men could access sterilisation by meeting eligibility criteria, while women faced the additional hurdle of having to demonstrate that their circumstances were exceptional compared with other women seeking the same procedure.

The Ombudsman concluded that this itself appeared to create health inequality in access.

Did the policy follow clinical guidance saying women should not be pressured into LARC?

The clinical guidance available to the NHS recognised LARC as highly effective.

But it also explicitly warned that women should not feel pressured into choosing LARC over female sterilisation.

That distinction is crucial.

Providing information about an alternative is informed consent.

Structuring access so that a woman effectively has to accept, attempt or justify rejecting the alternative is something very different.

The Ombudsman's provisional view was that the policy's reliance on the availability of other contraceptives was, in effect, pressuring women towards LARC.

It found that the NHS had not properly explained why it had departed from the clinical guidance it had itself considered.

What happened when new evidence emerged in 2021?

This is another part of the story that I find extraordinary.

By November 2021, the NHS was seeing enough requests for female sterilisation that its own paper reportedly observed that these women now appeared to represent a cohort, rather than exceptional individual cases.

That is important because the whole Individual Funding Request model depends upon exceptionality.

The system was effectively receiving evidence that the "exceptions" were not exceptional.

The committee agreed further work should be carried out on groups including women unable to tolerate other contraception, women who had undergone multiple caesareans and women for whom another pregnancy was contraindicated.

The action was later marked complete.

But the Ombudsman could find no proper documentary trail explaining how that work affected the policy.

The policy remained unchanged.

Indeed, an internal exchange later suggested uncertainty about whether the review was even still underway.

To me, this is the kind of thing that makes the word governance almost meaningless if nobody is required to show what actually happened.

So how "robust" was the governance process?

By the Ombudsman's provisional assessment, the ICB had:

• adopted a policy where evidence had not been appropriately balanced;
• failed to give proper regard to relevant legislation;
• failed to explain departures from clinical guidance;
• adopted a policy whose reasoning was not clearly recorded;
• failed to adequately investigate groups of women for whom alternative contraception was unsuitable;
• treated comparable male and female circumstances inconsistently;
• and inherited a major service change that had not undergone the public consultation it should have received.

And crucially, the Ombudsman said the ICB did not appear to have put those failures right.

I struggle to reconcile that with the phrase "robust governance process."

Was the complaint itself properly investigated?

No — and this matters almost as much as the policy itself.

My original complaint identified many of these problems before the Ombudsman ever became involved.

• I raised the evidence on regret.
• I raised cost-effectiveness.
• I raised consultation.
• I raised bodily autonomy.
• I raised side effects and health risks of other contraception.
• I raised the unequal treatment of vasectomy and female sterilisation.

The Ombudsman's provisional assessment found that the ICB repeatedly failed to engage with those issues.

Instead, the responses disproportionately focused on explaining the existing policy and the Individual Funding Request process.

In one of the most important sections of the report, the Ombudsman said the final CEO response only partially addressed the evidence question. It specifically noted that BOB ICB had not answered what research supported the claim about regret, why the difference between male and female policies did not amount to discrimination, or how bodily autonomy had been considered.

It also noted that my question about consultation had simply not been answered.

What did the Ombudsman ultimately say about my concerns?

For me, one paragraph cuts through years of institutional reassurance.

After independently examining the evidence, the Ombudsman said its provisional findings suggested that my views about the policy were likely to have been right.

It recognised that I had consistently and clearly laid out the evidential basis for my argument that the decision-making process was flawed.

That is difficult to square with an organisation whose own complaint process had spent months failing to answer those same questions.

Were the NHS CEO Dr Nick Broughton's statements lies?

This is where I separate the documentary finding from my personal conclusion.

I can say what I think - I have the right to my opinion - and you, dear reader, have access to the Evidence and can make your own opinion.

When the Chief Executive of an NHS organisation tells me a process was robust and the policy was developed following a full consideration of guidance, evidence, law and ethics — and an independent Ombudsman later finds evidence to the contrary, with unexplained departures from guidance, inconsistent treatment of men and women, inadequate records, missing consultation and poor complaint investigation — I regard those original assurances as lies.

Whether that resulted from deliberate dishonesty, institutional defensiveness, negligence, poor briefing or a culture in which senior leaders make claims about governance without interrogating whether they are true is a different question.

And, frankly, none of those explanations is reassuring.

Was this a cover-up?

Again, I use that term as my interpretation rather than as a legally established finding.

A cover-up does not always require a secret room full of people agreeing to conceal something. But honestly, if you keep reading about how defensive and evasive the ICB's leadership and organisation overall continued to be through and beyond the Ombudsman's investigation - you'd likely see it the way I do - the fish rots from the head down - and it truly stinks under the leadership of Nick Broughton.

Institutional concealment can be much more banal.

A complaint raises uncomfortable evidence. The organisation repeats its policy. The complainant is redirected towards an individual process. Questions are not answered. Delays accumulate. Senior assurance is provided. The complaint is closed.

If the person accepts the response, the underlying problem disappears administratively even though nothing has actually been resolved.

That is what I believe was happening here.

I think the system expected me to stop.

I did not.

What did the Ombudsman recommend should happen next?

The Ombudsman's provisional recommendations show how seriously it regarded the problems.

It proposed that BOB ICB should formally acknowledge and apologise for the failures, share the findings with the body responsible for recommending commissioning policies, explain how the female sterilisation policy would now be reviewed, ensure the same failures were not repeated, consult properly, examine the human factors that allowed the failures to occur, and improve its complaint-handling processes.

It also proposed that the final findings should be shared with NHS England and the Care Quality Commission.

That is a very long way from "everything went through a robust process."

Why does this matter beyond my own case?

Because I only got this far because I did not believe them.

I had the time, anger, research skills and stubbornness to keep opening documents, comparing dates, finding minutes, challenging assertions and eventually asking an independent body to investigate.

Most patients should never have to do that.

And most will not.

That leaves a frightening question.

This case has taught me that authority is not evidence.

A senior signature is not evidence.

A policy saying it was reviewed is not evidence that it was reviewed properly.

And an organisation calling its governance robust does not make the governance robust.

Sometimes you have to keep asking the deeply annoying question:

Show me.

Where can I see the evidence?

You can read my original complaint, the BOB ICB Chief Executive's response, the Ombudsman material and the wider documentary history in my Evidence Folder.
